OFFICIAL CONTEST RULES
2012 LOUIS SHANKS BRACKET CHALLENGE – KEYE-TV Local Rules
General
UPICKEM is an online game being sponsored and promoted by The Douglas Group, Inc. dba UPICKEM (hereafter, “UPICKEM”) and a number of television stations located in different cities (please review UPICKEM’s official rules). In addition to the national game conducted by UPICKEM, television broadcast station KEYE-TV will have one (1) grand prize from all participants in the Austin, TX DMA.
Who Can Enter
1. To be eligible to participate in this contest, entrants must be Texas residents who are 18 years of age or older and reside in the Austin, TX DMA. COUNTIES IN THE DMA: Llano, Gillespie, Blanco, Burnet, Williamson, Travis, Hays, Bastrop, Fayette, Milam, Bell, Caldwell, and Lee, Texas.
2. Employees of Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., Sinclair Communications, LLC, and any other company which owns, programs or provides other services to television broadcast stations KEYE-TV and Telemundo Austin (the “Station”), Louis Shanks Fine Furniture (collectively, the “Sponsor”), their affiliated companies, advertising and promotion agencies, any and all local television broadcast and cable stations, local radio and other media companies, and the immediate family members of each are ineligible. The term “immediate families” includes spouses, grandparents, parents, siblings, children and grandchildren.
How to Enter / How to Win
(a) No purchase is necessary to enter. Only one entry accepted per person. An entrant who is otherwise a winner may be disqualified if they are found to have entered the contest more than once under separate e-mail accounts.
(b) The contest starts on March 9, 2012 at approximately 11:00am CDT, and ends at 11:59 p.m. CDT on or about April 2, 2012 (the “Contest Period”). Station is not responsible for lost, late, or misdirected entries, or for printing errors, server unavailability, computer or any other electronic malfunction. If a game is canceled, forfeited, or indefinitely suspended for any reason, or if a game results in a tie, that game shall not count for any contestant and scores will be computed as if the game did not exist.
(c) To enter, log onto www.weareaustin.com and click on the “2012 LOUIS SHANKS BRACKET CHALLENGE” link. To enter each round of the “Round by Round” Contest entrants will pick the winners for each round of the tournament prior to the start of each round. All entries for each round entries must be submitted no later than 15 minutes prior to the first game of that round. The contest will be open for picking after the tournament bracket announcement telecast on national television the Sunday prior to the first basketball games. All picks must be entered before the published cutoff time on the pick pages. No mechanically reproduced or completed entries will be accepted.
(d) The dates for each of the basketball rounds are listed below:
First Round: March 15-16, 2012 Second Round: March 17-18, 2012 Third Round: March 22-23, 2012 Fourth Round: March 24-25, 2012 Fifth Round: Final Four: March 31, 2012 Sixth Round: National Championship: April 2, 2012
(e) Following the final game played each round during the Contest Period, entrants will receive a pre-determined number of points for each correct prediction. All entrants will be treated as having correctly predicted the winner of games ending in a tie. Points will be awarded by round for the round prize. In the event an entrant does not participate one week does not mean he can’t participate the following week. Participants can choose to play as much or as little as they see fit.
(f) Scoring for the "Round by Round" Game is as follows: The participant who picks the most correct games in each round will be the round winner, subject to verification. If a game is canceled, forfeited, or indefinitely suspended for any reason, that game shall not count for any participant and scores will be computed as if the game did not exist. In the event of a tie for the prize, the "Score Approximation Formula", described below, will be applied to determine the winner of the prize. In the event of a tie for the highest overall score the computer takes these tied participants that picked the championship game correctly and applies and applies the “Score Approximation Formula” found in the UPICKEM contest rules. (g) The Station is not responsible for lost, late, misdirected entries (including predictions), printing errors, software failure, server unavailability, computer or any other electronic malfunction. All entries received that are tampered with, illegible, or from ineligible entrants will be void. Entrants may not enter using multiple e-mail addresses or as multiple entrants. Any entrant who attempts to enter with multiple e-mail addresses or under multiple identities, or uses any other device to enter multiple times will be disqualified. All entries become the property of the Station and will not be acknowledged or returned.
(h) In the event a participant in the contest disputes the points that such participant receives for any round of the contest, that participant must notify the Station in writing of such dispute within five (5) days of the Station declaring the results for such week. The failure to notify the Station within such five (5) day period shall constitute the agreement of the participant that the determination of participant’s points by the Station is accurate and participant shall be deemed to have the number of points determined by the Station even if such determination was in error. Notifications to the Station may be done by clicking on the Feedback tab and submitting the completed online form.
(i) The Station reserves the right, in its sole discretion, to cancel or suspend the contest should virus, bugs, unauthorized human intervention, or other causes beyond the control of the Station, in its sole opinion, corrupt the administration, security, fairness, integrity, or proper operation of the contest or for any other reason at the sole discretion of the Station.
The Prize (s)
1. The Grand Prize winner will receive one (1) LG forty two inch (42”) 1080p LCD HDTV. The total grand prize value is $541.15. Delivery is not included.
2. The grand prize winner will be notified by phone and must sign and return a release and affidavit of eligibility within seven (7) days of notification at the time winner claims his/her prize in person at the Station. Before receiving prize, winner must provide their correct name, mailing address, email address and telephone number to the Station at the time of notification. Winners must show picture identification to claim prize. Station reserves the right to examine additional identification and may choose to accept or deny awarding the prize based on the identification presented.
3. All results posted are unofficial until winners respond to e-mail or phone notification.
4. If winner is not eligible to be the winner, does not timely respond to the notification, or does not timely return the affidavit of eligibility and release, then the prize will be forfeited, and the prize may be awarded to the entrant with the next highest score, as determined by the Station. The Station reserves the right to extend the time period by which the winner must take necessary action to claim the prize.
5. Winner, by acceptance of the prize, agrees to release all Sponsors, and their parent and subsidiary companies, their officers, directors, employees, agents, shareholders, affiliates, suppliers, distributors, and advertising agencies from all liability, claims, or actions of any kind whatsoever for injuries, damages, or losses to persons and property which may be sustained in connection with the receipt, ownership, or use of the prize.
6. There will be no substitutions or cash alternatives for prizes except at the sole discretion of the Station. The Station has the right to substitute a prize of similar value. No transfer or assignment of prizes is allowed.
7. The winners are responsible for paying all local, county, state and federal taxes on prizes based on the estimated retail value of the prizes as set forth in these rules.
8. Only one prize will be awarded per household.
9. Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., Sinclair Communications, LLC and the Station shall not be liable if the provider of any part of the prize fails to satisfy its obligations to furnish its portion of the prize.
10. Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., Sinclair Communications, LLC the Station and Sponsor are not responsible for any liabilities arising directly or indirectly from the award or use of the prize.
11. In claiming a prize, winner must acknowledge that Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., Sinclair Communications, LLC and the Station have the right to publicize winner’s name, character, likeness, photograph, and voice for promotional purposes without financial remuneration.
12. The Station shall not be responsible for the failure of any winner to claim a prize as a result of such winner’s failure to receive an e-mail from the Station regardless of the reason for such failure.
Miscellaneous
1. Winner will be listed on the contest website. Official rules are available online at www.weareaustin.com.
2. This contest is subject to all applicable laws and regulations and is void where prohibited. Sinclair Broadcast Group, Inc., Sinclair Television Group, Inc., Sinclair Communications, LLC and and Sponsors accept no responsibility or liability in connection with any injuries, losses or damages of any kind caused by or resulting from the acceptance, possession or use of any prize awarded hereunder.
3. All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of The Station or any sponsor, shall be governed by and construed in accordance with laws of the State of Maryland, without giving effect to any choice of law or conflict of law rules or provisions (whether Maryland or any other jurisdiction) that would cause the application of the laws of any other jurisdiction other than Maryland. The invalidity of unenforceability of any provision of these rules shall not affect the validity or enforceability of any other provision. If any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as of the invalid or unenforceable provision was not contained therein. All claims relating to the contest must be brought in the federal or state courts located in Baltimore County, Maryland, which shall have the exclusive jurisdiction and venue over such claims.
4. The Station cannot be held liable for any lost or stolen entries, prizes or contest information.
5. The Station reserves the right to make rules and contest changes and change the aforementioned contest dates at any time and in its sole discretion.
